Description

In this PR we correct the exception on open source AI (Artikel 2.12, Artikel 53b and Overweging 104):

  • Fix that all AI-systems and AI-systems for general purposes with no transparency obligations are redirected to the question on open source. If they are open-source they are not obligated to comply with the AIA (Article 2.12) and are redirected to conclusion 11.2. If they are not open-source they are obligated to comply with the AIA and are redirected to the appropriate conclusion (12 tm 14).

  • Fix that all AI-systems and AI-systems for general purposes with no high-risk are redirected to the question on open source. If they are open-source they are not obligated to comply with the AIA (Article 2.12). If they are not open-source they are obligated to comply with the AIA and are redirected to the appropriate conclusion (12 tm 14).

  • Ensure that providers of GPAI-models without a systemic risk are redirected to the question on open source. If they are open-source they are not obligated to comply with c and d of article 53 according to overweging 104 (conclusion "14.2.3" and "12.2.3"). If they are not open-source they are obligated to comply with the full AIA and are redirected to the appropriate conclusion ("14.2.2" or "12.2.2").

Note:

  • The decision tree does not yet facilitate "else" statements
