What condition portlet navigation don't list an item?

I'm writing a collective.cover tile to list the same items as portlet navigation, but I find it's logic too complex for my needs.

So I wrote the follow logic: List all items in the first level inside the current context that are published and not set to exclude from navigation.

But sometimes I find that the results are not the same as portlet navigation, is it possible to help me to list all cases where an item should or should not be visible in this kind of tile or portlet?
